Why shall producing data virus bee illegal all over the world?

According to my opinion it is a crime to produce data virus if the virus infect my property/computer, in the same way, as it is a crime to enter my apartment, or install anything in my apartment, without my knowledge or my agreement.

If some of my property is damaged by data virus, it is also according to my opinion, the virus producer that is responsible for the damage and in the same way as in other terrorist actions, it is the producer of a destruction mechanism that is responsible for the damage and not anyone else that without knowledge and unintentionally carried out or delivered the destruction mechanism.
A airplane pilot is not responsible for a terrorist bomb in an airplane,
it is first of all the producer of the bomb.

If some of my physical papers on my desktop is destroyed or stolen by a burglar, that is a separate crime as well as the illegal encroachment itself is a crime. But the same information that is stored on the papers can be stored in many other different ways and medias. It can also be stored on plastic film, microfilm, or encoded in the form of TV video- or audio signals on TV video- or audiotape.
If information on any of this storage medias is illegal destroyed, which ever of the above media it is,
it is a crime done! Such is the law today!
According to my opinion the storage of data files on magnetic media intended for computers to read and write, is only another way to encode and store my information, fully comparable with any other magnetic storage media such as TV video machines or audio tape recorders. Even though the decoding method is well known by a public word processor, image- or CAD-program or other data program, as well as the decoding method is well known for TV video- and audiotape signals.
Therefore it is also a crime to destroy my data files whether I have backup or not.
But! If I don't have backup on my destroyed data files, my lost will be greater and my claims for compensation becomes greater.

It is often said that: -"You can't take physically on data information! And that's why it isn't considered to be a crime to destroy it!" Of course you can take physically on data information, you can hold the hard disk, diskette, data tape or CD in your physical hand, in exactly the same way that you can hold information stored on videotape and audiotape in your physical hand! But even if you can't use the same type of equipment to retrieve the information from the different medias it must, according to my opinion, be a crime to steal or destroy any of them, computerstoragemedias included!
There are several test cases around the world, where some employee in a company has destroyed data for there employer, stored on datastoreagemedia (probably data on the hard disk of some fileserver), and they have very often been condemned for it, if they have been found guilty.
What is the principal difference, in the destruction crime itself, between destroying data for some random stranger, and to destroy data for an employer? According to my opinion there is no difference, it is both a crime that should be punished!

If any of my data files and/or computer property is damaged in any way by data virus, even if someone else than the original virus producer take the virus and intentionally sends it to someone else, the virus producer itself, must according to my opinion, be prosecuted for conspiracy to damage against private property along with, but independent of, anyone else that intentionally has spread the virus.

To proof of guilt against a certain virus producer will probably be very hard.
But we all normal PC-users need to have a beginning to the end of the virus pain in some way and therefore it is very well worth the small amount of time it takes to make a notification of virus damage to the police!

In this case, the success will come if, and only if, very many people pitch the first stones on virus producers!
If the demands for compensation are great enough, then will tremendous strong economical interests for sure also "wash them out" from anywhere, the will not be able to hide in any world!

This is some of my points on how I see datavirusproduction as a crime!

DO NOT HESITATE TO MAKE A NOTIFICATION OF VIRUS DAMAGE TO THE POLICE

FIRST OF ALL: It will only take about half an hour at the police office! I'm sure it will be worth it!

SECOND: If you should have had any illegal software on your HD along with legal data that you have lost, don't bee afraid, you can't be busted with it - it is also destroyed for ever and can't be recovered unless you don't leave your HD to professionals on data recovery from crashed HD, and that is quite expensive for private persons.

So! Do not be afraid to report your lost to the police!
You have all to win and nothing to loose!

Here is some tip if you shall make notification of virus damage to the police!

Make a notification of damage to the police in ANY of this cases:
- If your computer or HD is hit and damaged by data virus in any way!
- If you have lost valuable data that can't be easily recovered from backup!
- If you will have quite much work to get your computer in order again!
- If you have lost many files downloaded from the internet,
and you don't have your own backup of them!

What to think of when you are hit by data virus!
Make your notification of the damage immediately when you are reasonably sure about that the lost is caused by data virus, if it appear not to be a data virus you can always take back your notification.
Make the notification of the damage to the police before you try to recover any remaining data,
and before you update your own antivirusprogram to detect the virus that caused the damage.

When you make your notification of the damage the police, ask the police if you are allowed to disinfect your computer, or if necessary, if you are allowed to reformat your HD.

If you have some backup which you believe is infected by the virus that caused your damaged, save it carefully, make a copy if possible, and try (my be some friend can help you) to get en antivirusprogram log / disinfections log from the backup without changing the original backup files. This files will be your proof of what virus it was that caused your damaged.
Because, if some good antivirusprogram can identify the virus you can be sure of what virus it is that has destroyed your data files.

If possible, find some reliable witness to the damage!

If you have any home insurance, try how they handle this kind of unlawful encroachment and damage!

Claim for compensation
Claim for a very reasonable compensation that you can make very credible in a court it is the minimum value of your lost.
Remember that it is the great amount of claims from very very many people that will bust the virus producers, not the individual claim!
But if a virus producer is found guilty in court, it might be possible for you to get some of your claims!
